FormaCAD Terms of Use
Last updated: October 19, 2026
These Terms of Use (the "Terms") are an agreement between you and the operator of FormaCAD, a sole proprietorship operating under the name "FormaCAD" in Canada ("FormaCAD", "we", "us", "our") and govern your use of the FormaCAD website, web application and desktop application (the "Service"). Please read them together with our Privacy Policy, which is part of these Terms.
By creating an account, clicking to accept, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
FormaCAD is an original 2D drafting application. It is not affiliated with, endorsed by, or sponsored by Autodesk, Inc. or any other CAD vendor, and other companies' names are the trademarks of their owners.
1. Who may use the Service
- You must be old enough to form a binding contract where you live (the age of majority). If you are younger, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms for you. The Service is not for children under 13.
- If you use the Service for an organization, you confirm you may bind it to these Terms.
- You must not use the Service if you are barred from doing so under applicable law, including sanctions and export control laws.
2. Your account
- You must give accurate information and keep your sign-in credentials secure. You are responsible for activity under your account. Tell us promptly at support@formacad.app if you suspect unauthorized use.
- You may use one account per person. Do not share an account.
- You may delete your account at any time from the account menu. See the Privacy Policy for what happens to your information.
3. Plans, limits and advertising
- Guest preview. You may try the Service for a limited time without an account. After the preview ends you must sign in or create an account to continue.
- Free plan. Supported by advertising. At this time there is no limit on how often you can save or export.
- We may change plans, limits and features. Changes to the Service or these Terms apply going forward.
4. Your content and your files
- You own your drawings. Files you create, import or export with the Service remain yours. We do not claim any ownership of them.
- Your drawings are processed on your device and are not uploaded to us (see the Privacy Policy). You are responsible for keeping your own copies and backups. We are not responsible for lost or corrupted files.
- You confirm you have the right to import and work on any file you open in the Service (for example a PDF, image or DXF), and that doing so does not infringe anyone's rights.
- The same applies to pictures, documents and product information you bring into a drawing from websites or other sources (for example with a component's "Load information"): you are responsible for having the right to use them, and the Service only fetches what you ask for.
- Fonts you choose for text are loaded from Google Fonts under their own open licenses (OFL or Apache); commercial font names are shown with a free look-alike when the font is not installed on your device.
- If you send us feedback, ideas or suggestions, you allow us to use them freely without obligation to you.
5. Our rights and license to you
- The Service, including its software, design, icons, fonts and documentation, is owned by us or our licensors and protected by copyright, trademark and other laws. "FormaCAD" is our name.
- We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own lawful purposes, subject to these Terms.
- Some parts of the Service use third-party open-source software under their own licenses, listed in
THIRD_PARTY_LICENSES. Those licenses apply to those parts.
6. Acceptable use
You agree not to:
- break the law or infringe anyone's rights;
- copy, modify, resell, sublicense, rent or distribute the Service, except as the law allows;
- reverse engineer, decompile or attempt to extract source code, except where the law allows despite this restriction;
- bypass, disable or tamper with usage limits, advertising, watermarks, sign-in or security features (including by modifying the software running in your browser or calling our servers in a way we did not intend);
- use bots, scrapers or automated means, or overload or disrupt the Service or its networks;
- attempt to gain unauthorized access to accounts, systems or data;
- upload or send malware or malicious files;
- use the Service to build a competing product by copying it, or in a way that suggests we endorse you.
We may suspend or limit access if we reasonably believe you are breaking these Terms or putting the Service or others at risk.
7. Professional and engineering disclaimer
FormaCAD is a drafting and design aid. It does not provide engineering, architectural, structural, safety, legal or code-compliance advice. Quantities, schedules, dimensions and any other output are produced from the inputs and rules you provide and may contain errors or not fit your project. You are responsible for verifying all output before relying on it for design, fabrication, ordering, construction or any safety-related purpose, and a qualified professional must review it where the law or good practice requires. We are not responsible for material, labor, or other costs arising from the use of output that was not verified.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that the Service will meet your requirements, that files will be free of errors, or that it will be available at all times. Some places do not allow certain disclaimers; in those places they apply only to the extent permitted.
9. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or related to the Service or these Terms, even if we were advised they might occur.
- Our total liability for any claim arising from or related to the Service or these Terms is limited to CA$50.
- These limits do not exclude or limit liability that cannot be excluded or limited by law, including liability for fraud, gross negligence or intentional misconduct, or for death or personal injury caused by negligence, and they do not limit your statutory consumer rights (including those in Quebec and other Canadian provinces, and in U.S. states such as California). Some places do not allow the exclusion or limitation of certain damages, so parts of this Section may not apply to you.
10. Indemnity
To the extent permitted by law, you agree to defend and indemnify us and our officers, employees and contractors against claims, damages and costs (including reasonable legal fees) arising from your misuse of the Service, your breach of these Terms, or your infringement of another's rights. This Section does not apply to consumers where prohibited by law.
11. Third-party services
The Service relies on third parties (for example authentication, hosting and advertising providers). We are not responsible for their services, and they may change or fail. Links to third-party websites are provided for convenience only.
12. Copyright complaints (DMCA and Canadian Copyright Act)
If you believe content available through the Service infringes your copyright, send a notice to our designated agent with: your signature; identification of the work and of the material claimed to infringe; your contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.
Send the notice to support@formacad.app. Because your drawings are not stored on our servers, we generally have no content to remove, and we will respond by other appropriate means. We may end the accounts of repeat infringers.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or end your access at any time, with notice where practicable, if you breach these Terms, if required by law, or if we stop offering the Service. Sections that by their nature should survive (ownership, disclaimers, limits of liability, indemnity, governing law) survive termination.
14. Changes to these Terms
We may update these Terms. We will post the new version with a new "Last updated" date. If a change is material, we will give notice in the Service or by email before it takes effect. If you keep using the Service after the effective date, you accept the update. If you do not agree, stop using the Service and delete your account.
15. Governing law and disputes
- These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. If you are a consumer, you also have the protection of the mandatory laws of the place where you live.
- Informal resolution first. Write to support@formacad.app and give us 30 days to try to resolve the issue.
- Otherwise, disputes will be decided by the courts of the Province of Ontario, Canada, and you and we submit to their jurisdiction, except that you may always bring a claim in the courts of the place where you live if the law gives you that right.
- Nothing prevents you from contacting a consumer protection authority or privacy regulator.
16. Notice to California residents
Under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
17. Notice for Quebec
If you live in Quebec: you and we have expressly required that these Terms and related documents be drawn up in English (Les parties ont expressément exigé que les présentes conditions soient rédigées en anglais).
18. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- Severability. If a part is unenforceable, the rest stays in effect.
- No waiver. Not enforcing a right is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in a merger, sale or reorganization.
- Electronic communications. You agree that we may communicate with you electronically, and that electronic notices satisfy legal requirements for written notices.
- Export and sanctions. You may not use the Service in violation of applicable export control and sanctions laws.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
